We reserve the right to alter this Data Protection Declaration from time to time in accordance with the legal provisions. We will immediately publish all alterations on the websites.

1. Our principles for the processing of personal data

1.1 How we process personal data

The protection of your privacy as well as the security of your personal data is a major concern that we consider in all our business processes. Accordingly, we always handle your personal data confidentially and in accordance with the legal provisions.

We further comply with the Children's Online Privacy Protection Act (www.coppa.org). Our websites, services and products are not intended for children under the age of 13. If you believe that we process data of a child under the age of 13, we kindly ask you to inform us immediately.

When we process data about you, we will inform you in advance or as soon as possible about such data processing, its purpose and legal basis (incl. possibly involved justified interests), the possible disclosure of data to third parties (incl. information regarding the respective third country), the duration of data storage, our contact information (incl. representative and data protection officer) as well as your rights regarding the respective data processing. Furthermore, we will always process your personal data only for those purposes for which we have collected them or for which you have given your consent at a later point in time.

1.2 What we do for the security of your personal data

We do not sell your personal data or disclose them in any other way to third parties unless you have expressly given your consent or we are obliged to do so due to a court or administrative order. Exempted are our service providers and contractual partners who support us with the operation of our websites and the delivery of our services and products and with whom we have concluded non-disclosure agreements.

We take appropriate technical and organisational security precautions to protect your personal data against manipulation, loss, destruction and unauthorised access. Additionally, we verify the correctness and completeness of data through appropriate measures. Despite these efforts, we cannot guarantee the security and correctness of your personal data.

1.3 When do we erase your personal data again

We process your personal data only as long as we need them for the given purpose. If we process your personal data based on your consent, we will immediately terminate such processing as soon as you withdraw your consent. Otherwise we will erase your personal data after 10 years unless circumstances exist which legally permit to not erase them (e.g. fulfilment of contract, accounting and declaration obligations etc.) or there is a specific business interest in the further storage or processing of the respective personal data.

2. When you visit our websites

We provide you with information regarding Semadeni Industry Group and our services and products on our websites. You can also directly contact us via a contact form or via a real-time chat or open a customer account on our website.

2.1 What data we process about you

We process data regarding your use of our websites (e.g. IP address, location, browser, operating system, reference source, visit duration, page views, downloaded files, selected links, search terms, navigation paths and information regarding the point of time, frequency and pattern of website usage). If your visit is the result of online advertising (e.g. banner advertisement, search engine advertisement etc.), we also record which element motivated you to visit the website.

We use small text files on our websites which your web browser will save on your computer („cookies“). During your use of our web presence, we use “Session Cookies” that are erased when you close the web browser and mainly serve connection control and navigation purposes. We also partially use persistent cookies which enable us to recognise you during your next visit.

You may also open our websites without cookies. You may prevent the setting of cookies by selecting the “disable cookies” option in your web browser settings. Please refer to the manual of your web browser to know how this works in detail. If you do not accept cookies, you may not be able to use all functions of our websites.

Such processing of your personal data takes place based on our justified interest in the operation, provision, monitoring, securing and permanent improvement of our websites, products and services and, as the case may be, based on your consent which you may withdraw at any time.

2.2 Use of Google Analytics analysis services (with IP anonymisation)

Our websites use Google Analytics (www.google.com/analytics) by Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Thus, data, sessions and interactions may be attributed to a pseudonymous user ID across several devices and activities may be analysed. To do so, Google Analytics uses Cookies that are stored on your computer and enable the analysis of your website use. The respective information will be transferred to a Google server in the USA and stored. However, due to the activated IP anonymisation, your IP address will be shortened by Google beforehand. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened only afterwards. The IP address transferred in the scope of Google Analytics will not be joined with other Google data.

Google uses the information on our behalf to analyse your website use, compile reports about website activities and provide further services related to website and internet use. The data will be erased after 14 months.

Google is certified under the data protection agreement “Privacy Shield” and is committed to comply with the EU data protection requirements. Also, we have concluded a contract data processing agreement with Google which obliges Google to protect the data of our customers and to not disclose such data to third parties. You can prevent the processing of data created using cookies and relating to your website use by downloading a web browser add-on here and thus prevent the collection of data by Google Analytics when visiting a website.

2.3 Use of LiveChat chat services

On our websites, we use LiveChat (www.livechat.com) by LiveChat Inc., 1 Int. Place 1400, Boston, MA 02110, USA. This service allows us to have a personal conversation with you in the form of a real-time chat during your visit to our websites LiveChat uses cookies and save in them information about you, the conversation conducted and your use of LiveChat. This information is normally transferred to a LiveChat server in the USA and is stored there. LiveChat uses these data to enable your real-time chat with us.

LiveChat is certified under the data protection agreement “Privacy Shield” and is committed to comply with the EU data protection requirements. By using the chat button on our websites, you start the real-time chat and thus consent to the processing of your personal data by LiveChat as well as the transfer of all inputs to the USA. You may request information on all data stored by LiveChat from us and to have them erased.

3. If you subscribe to our newsletter

We use our newsletters to inform you up to six times per year about our products, campaigns and special offers as well as other topicalities of Semadeni Industry Group and possibly send you invitations to fairs and other events. If you wish, we will also be pleased to deliver our respective current order catalogue by mail to you once a year.

3.1 What data we process about you

If you want to subscribe to our newsletter, we will require your e-mail address. Optionally, we ask you to provide your first name and surname and your address so that we can personally address the newsletter to you. Providing us with your address data is mandatory if you want to subscribe to our catalogue. Furthermore, we ask you to tell us which subjects you are interested in so that we will only inform you about topicalities effectively relevant to you. All registrations and possible alterations (incl. point of time of registration and confirmation and IP address) will be recorded to document the registration process in accordance with legal requirements.

The newsletters additionally contain a small file that is accessed when you open the newsletter (“web beacon”). In the course of such retrieval, technical information (e.g. type of bowser and system, IP address and point of time of retrieval) will be collected. This information will be used to technically improve the services and access times as well as to collect statistical data.

The statistical data include whether and when a newsletter has been opened and which links are clicked. For technical reasons, this information can be attributed to individual newsletter subscribers. However, it is not our objective to monitor individual users. The analyses rather serves to determine the reading habits of our users in total and to adapt our contents accordingly or to send different contents in keeping with the interests of our users.

Such processing of your personal data takes place based on your consent. Electronic registration for the newsletter or the catalogue delivery can be made on our websites using a double-opt-in process. Following your registration you will receive an e-mail in which you will be asked to confirm your registration. You may withdraw your consent at any time (see below 3.3).

3.2 Use of MailChimp e-mail marketing services

Our newsletter is sent via MailChimp (https://mailchimp.com/) by Rocket Science Group LLC, 675 Ponce De Leon Ave NE 5000, Atlanta, GA 30308, USA. The e-mail addresses of our subscribers and other data mentioned here are stored on MailChimp servers in the USA. MailChimp uses this information for sending and assessing the newsletters on our behalf. MailChimp further uses the data to improve their own services (e.g. to optimise the sending procedure and display of newsletters), to determine the countries of recipients and for other economic purposes. However, MailChimp does not use the data of our newsletter subscribers to contact them on their on behalf or forward the data to third parties.

Also, we have concluded a contract data processing agreement with MailChimp which obliges MailChimp to protect the data of our customers and to not disclose such data to third parties. Occasionally, we redirect our subscribers to the websites of MailChimp. Thus, our newsletters contain a link through which the newsletter can be accessed online. Additionally, subscribers can update their delivery data on the MailChimp website. MailChimp websites use cookies to process the personal data of users. We have no influence on this processing of data. You can find more information here.

3.3 Termination of the subscription

 

You may withdraw your consent given for the receipt of our newsletter or catalogue at any time. This will also nullify your consents to its sending via MailChimp and their statistical analyses. It is not possible to separately withdraw the consent to the sending via MailChimp and the statistical assessment. You can find a link to unsubscribe from our newsletter at the end of each newsletter.

Moreover, we will ask you to confirm your subscription of the newsletter after two years following your registration to the newsletter. Without your renewed confirmation, we will neither send any more newsletters or carry out any more statistical analyses.

4. When contacting us or using our services or products

You can directly purchase some of our products and services in our e-shop on our websites. Alternatively, you can also order our services via telephone, web form, e-mail or post. If you provide us with your e-mail address, we will subsequently prefer to communicate with you via e-mail.

4.1 What data we process about you

If you interact with us on our websites or in any other way (e.g. per telephone, e-mail, contact form, by participating in competitions or surveys), we use all data provided to us including their metadata to process your query, for correspondence with you and for general customer service and marketing purposes. Without your consent, we only disclose your personal data to third parties if this is required to fulfil a legal obligation.

When you place an order in our e-shop, you will be required to provide your e-mail address, first name and surname as well as your address and telephone number. You will also be asked to choose a password when registering for a customer account. In addition, you can register your billing and delivery address in the course of the ordering process. We also require this information if you use our services or products in any other way. We process your personal data obtained in the course of contract conclusions only to fulfil our contractual and legal obligations as well as for customer service, quality assurance and warranty claims. If you give us your consent during the order process, we will also deliver our respective current catalogue to you once a year. Also, your personal data will be disclosed without your express consent exclusively for these purposes (e.g. parcel service, haulier etc.).

Such processing of your personal data is based on the initiation and fulfilment of a contract, the fulfilment of legal obligations or your consent, which you may withdraw at any time.

4.2 Use of credit reference agencies in the case of payment on invoice

To protect us against payment defaults in case of payment on invoice, we check your financial standing prior to the conclusion of a purchase contract or service agreement. This also protects you in a way against fraud and other criminal offences. In the frame of this check of your creditworthiness, we use all data available to us and determine whether we can offer payment on invoice. In this context, your previous orders will also be checked. We also check whether the delivery address deviates from the billing address and whether it is a new delivery address. We also consult external data and transfer your first name and surname or your company name, address and possibly your date of birth to the following credit reference agencies:

These credit reference agencies use the above data to assess your financial standing regarding the respective order based on mathematical-statistical methods as well as their own data stock. We have concluded a contract data processing agreement with these credit reference agencies that obliges them to protect the data of our customers and to not disclose such data to third parties.

Such processing of your personal data takes place in the course of the initiation and fulfilment of contracts and based on our justified interest to prevent payment defaults and criminal offences. If you do not agree to the modes of payment provided, you can contact us in writing or via e-mail to info(at)semadeni.com. We will then re-check our decision.

5. Warranty and liability limitation

We create our websites, services and products with the greatest care. However, we cannot guarantee the accuracy and correctness of contents and therefore exclude any liability and warranty in this regard. Furthermore, our websites also contain links to web pages of third parties. After you have clicked a link, we have no more influence on the processing of personal data by such third parties and exclude any liability or warranty in this regard as well. The present data protection principles do not apply to linked websites.
